Oh, I say that if he has done something to contribute to your thoughts on your kids moving to California(beating, drug abuse, cheating, ect.) then I would'nt move them. But growing up I had no dad, he was there there for me and it was pure Hell. personally I would move to wherever he moved to.

Comment on: On Paying Past Due Bills

That is fine, if you see that you can make the actual minimum payment due. I am, of course not, saying that you should totally skip out on your obligations to pay a debt.

What i am trying to clarify here, is the fact, that any type of payment is legal, and certainly better than none at all.

I mean, look at how many people are literally starving, in order, to keep their bills paid. Many of them do not know how to deal with phone collection agencies, and just like a certain 80 year old man, that i talked to recently, he feels terroized by the calls. He quicly gives in, just to make them happy.

True enough, you can report them by calling certain places. But the sad fact is, the credit collections and other companies still use these tactics, even though they are illegal.

I disagree with some of your post.

Yes, you should pay the necessities first: mortgage, car note, insurance, utilities, groceries, etc...

However, when it comes to credit cards and hospital bills, while you do have legal rights, they vary from state to state. No, they cannot threaten, harass, insult, etc to get you to pay more - that is illegal in any state and you can file a complaint with the state attorney general's office.

As a matter of fact, the NYS attorney general has cracked down on collection agencies in Buffalo and is in the process of closing them.

As for hospital bills, contact the hospital business office - they can usually make adjustments, payment arrangements, and sometimes even write the bill off altogether depending on your insurance/financial circumstances.

As for credit cards, again, make the minimum payment to the credit card company - if possible. If it is a debt collection agency, you can sometimes still make payments to the original company ( depending on how old the debt is)  other times the debt may have been sold to the collection agency and therefore you are liable for the balance to the agency.  Again, contact your state attorney general for the correct information on how to work with a collection agency.

Always keep track of payments made, who you talked to, when you talked to them, and what was said. If you can record the conversation - even better!

Finally, never, EVER rely on a "system" to clear up your credit! You hear advertisements for proven systems to reduce or eliminate your debt overnight - SCAM!!!!

If you ever see an ad for a "proven system" for anything - walk away -don't waste your money - the only one making money in that situation is the person selling the system...

WHY?  You have destroyed this man, and your children's sense of family...why? What did he do? beat you? abuse your children? drink, gamble, do drugs? You walked away from him and now you want to tear your children away from the only father they have ever known... WHY? Just because you say so? Washington and California are not that far away - why can't they have visitation with their father? He is in financial ruin because he supports his children and thats a bad thing?

Sorry, but I don't buy it. IMHO I think you are a vindictive woman trying to destroy this man, for no reason other than you have the ability to do so. 7 years of court battles is enough. Grow up and be the mother you are supposed to be - do what is best for those children and allow them to see their father.

They will never accept your proposal on the phone. They are more interested in getting all the money they can. They will even go as far, as insulting, threatening, and anything else, just to get you to pay out more, than you can afford to.

You can actually pay the mininum amount due, if you can afford to. Many of the people have shown that they are running into trouble by using that method, and leaving themselves with little to no cash.

However, by state law, if a company accepts a payment from you, regardless of the amount, then you have in all good faith made a payment. It is essential to keep your receipts and payment stubs showing any and all payments that you have made.

If you make a payment, and they refuse the payment, you have rights, under the law. Keep all letters, including the returned check or money order. You will need this as proof, that your payment was indeed rejected.

I disagree with the credit card info they will not take less than the minimum amount

Even Suze Orman changed her views and said better to pay minimun amount and have cash on hand in the bank. But cc companies are reducing the rate available if you don't pay it off.

On Paying Past Due Bills

By shirleybill - on Aug 18, 2009

As unlikely as it may seem, there are ways around those old bills, that seem to keep popping up, and bothering you constantly.

First, consider paying, only the bills that are the most important, such as your house note, utility bills, car note, insurance.

If a bill comes in that is a credit card bill, hospital bill, etc., send only what you can. Do not send the minimum amount, since this will run you short on your money. Send them what you can afford to send. Even if it is just a dollar a month, if they accept it, then you are in good standing. If they refuse it, be sure to keep the letter of refusal, along with the payment showing where you attempted to make the payment. Keep those documents together. When it comes down to it, and you show proof of trying to make a payment, and honor your obligations, then the courst, credit bereau, and anyone else, will have to stand with you, since you will have documented proof.

Guardian Ad Litem

By mjohnso - on Feb 21, 2008

Hey everyone, thanks for reading this. I'm down to the wire, with my back to the wall. I have nowhere else to go with this, so I'm putting out my personal information. I don't do that. Ever. So please understand how desperate I am for a solution.

The situation begins with a crappy marriage to a crappy person. A divorce happens, and since then - 7 years worth of court battles. My ex-husband has taken me to court for everything under the sun. Mutual friends say that I hurt his ego when I left without looking back. Nearly everything he has taken me to court for, he has lost. The few things that he hasn't lost at, have been things like support modification, etc. things that there is no "win, lose" outcome. Since our divorce, I have taken him to court ONCE, and that was for contempt. I won. I won big.

February 8th of this year, I won in court again. I represented myself because I have no money left. March 12th is the next time we go to court for trial. We're going to court because my exhusband is out of options - he has tried to terminate my contact with our children every way possible, but has repeatedly failed. Now he is trying to move out of state. His basis for moving is financial. He says he is in financial ruins (yet buys two ipods, nintendo DS and other things for our children) therefore he must move to California.

On to the nitty gritty... I want to get a Guardian Ad Litem (GAL) involved. For those not "in the know" a GAL is an advocate that looks into what is best for the children. It is my belief that a move to California (or anywhere) at this time, would be extremely harmful to our children. Their therapist says that it would likely reactivate their trauma and send them spiraling downward. My ex husband says that it would only be an "inconvenience" to our children. I want to get a GAL involved to get to the bottom of the issue. Should they be moved or not?

I am 100% convinced they SHOULD NOT BE MOVED. I am fairly certain that a GAL would agree with me. In order to hire a GAL, I need to pay her retainer fee. On the low end, I have spoken with Shirley Twohig, and her retainer is $1,400. On the high end, I have spoken with June Hendersen's office, and she is $2,000.

I have no money left. Business has been very slow, Mark has taken everything out of his TSP, we have nothing left in savings, all bonds have been cashed, all parents are tapped out... I come to all of you, asking - begging for help. Could you, and will you put up whatever you can each to help me please? If I could get 70 people to give $20 each, that is the retainer for Shirley.

I definitely cannot pay you back anytime soon. I can promise that I will try my best though, to get the money back to you as soon as I can. It could be quite a few months though, and not everyone at once. Just one person at a time.

Can and will any of you help me please? I don't have anywhere else to turn. I need to raise the money this week, because there is precious little time for the GAL to investigate and prepare for trial.

If not, thank you for reading anyway. I would appreciate all the prayers, vibes, karma, juju, etc. you can send me to help me out.

Due to illness fell behind on rent

By Penelope - on Jun 14, 2007
Posted in Penelope

Hello!  About a month and a half ago I fell behind on my rent due to an illness. Even though I talked to my landlord and have been making him payments, we are still going to court on June 25th. I have been a good tenant for two years now and this is the only time I have been behind.  I am about $900 in arrears. Any help would be appreciated and evenually padi back.  I hope to start my new promotion soon, so it is not out of the relm of possibility for me to make repayments within the next 3 months.  Thank in advance for whoever can help.
